Subject: Central Civil Services (Conduct) Rules, 1964 — Filing of annual Immovable Property Returns – regarding
The undersigned is directed to state that as per various notifications issued by this Department, relating to the Public Servants (Furnishing of Information and Annual Returns of Assets and Liabilities and the Limits for Exemption of Assets in Filing Returns) under the Lokpal and Lokayuktas Act, 2013, the public servant who has filed declaration, information and annual returns of property under the provision of the rules applicable to such public servant, should file the declaration, information and return indicating his/her assets and liabilities, as on 01.08.2014, to the competent authority on or before, 30.04.2015. The notifications are available on the Department’s website at http://persmin.gov.in/Lokpal HomePage From CCIS.asp.
2. The Central Civil Services (Conduct) Rules, 1964, are being amended to align them with the Lokpal and Lokayuktas Act, 2013. Presently, as per the Rule 18(1)(ii) of the Central Civil Services (Conduct) Rules, 1964, every Government servant belonging to any service or holding any post included in Group ‘A’ and Group ‘B’ is required to submit an annual return regarding the immovable property inherited/owned/ acquired/ held on lease or mortgage either in his own name or in the name of any family member or in the name of any other person.
3. It has, inter-alia, been clarified by this Department vide Office Memorandum No. 407/12/2014-AVD-IV(B) dated 13.01.2015 that the requirement of filing returns regarding assets and liabilities under the Lokpal Act is in addition to, and not in supersession of the requirement of filing similar returns under the existing Conduct Rules. In view of this, all Government Servants may be directed as follows:
(i) The annual Immovable Property Return, as on 31.12.2014, under the existing CCS(Conduct) Rules, 1964 is required to be filed on or before 31.01.2015;
(ii) The first return under the Lokpal Act (as on 01.08.2014) should be filed on or before 30.04.2015; and
(iii) The next annual return under the Lokpal Act, for the year ending 31.03.2015 should be filed on or before 31.07.2015.
4. It is, therefore, requested that all concerned may be suitably advised to file the Immovable Property Returns (IPRs) and the return under the Lokpal Act as per the dates indicated above, Further, in accordance with the instruction contained in this Department’s Office Memorandum No. 11013/3/2011-Estt.A dated 11.04.2011, IPRs (to be submitted by 31 st January of each year) shall be placed in public domain by 31 st March of that year. A compliance report in respect of the IPRs filed by Group ‘A’ Officers of the Central Civil Services, as on 31.01.2015, may please be furnished to this Department by 30.04.2015.
5. Similar action may kindly be taken by the authorities controlling services not covered by the Central Civil Services (Conduct) Rules, 1964.

Subject:- Central Civil Services (Leave Travel Concession) Rules, 1988 —Relaxation to travel by private airlines to visit J&K.
The undersigned is directed to refer to this Ministry’s O.M. No. 31011/3/2014- Estt.(A-IV) dated 26th September, 2014. It has been decided that the Government servants while availing Leave Travel Concession (LTC) to Jammu and Kashmir (J&K) under the special dispensation scheme allowed by the aforesaid O.M. may also travel by private airlines subject to the following conditions:-
(i) Officers entitled to travel by air may also travel by private airlines from their headquarters;
(ii) Officers not entitled to travel by air may be permitted to travel by private airlines between Delhi /Amritsar and any place in J&K.
2. Air travel by private airlines is to be performed in Economy Class only an at LTC- 80 fare of Air India or less.
3. Air Tickets to be purchased directly from the airlines (Booking counters, website of airlines) or by utilizing the service of Authorized Travel Agents viz. ‘M/s Balmer Lawrie & Company’, ‘M/s Ashok Travels & Tours’ and ‘IRCTC’ (to the extent IRCTC is authorized as per DoPT’s O.M. No. 31011/6/2002-Est (A) dated 02.12.2009) while undertaking LTC journey. Booking of tickets through other agencies is not permitted.
4. All other conditions prescribed in this Ministry’s Q.M. No. 31011/3/2014-Estt(A- IV) dated 26.09.2014 would continue to apply.
5. The order will remain in force for a period of one year from the date of issue of this order.

Central Civil Services (Conduct) Second Amendment Rules, 2014.
NOTIFICATION
New Delhi, the 31st October, 2014
G.S.R. 823(E).— In exercise of the powers conferred by the proviso to article 309 and clause (5) of article 148 of the Constitution and after consultation with the Comptroller and Auditor General of India in relation to persons serving in the Indian Audit and Accounts Department, the President hereby makes the following rules further to amend the Central Civil Services (Conduct) Rules, 1964, namely:-
1. (1) These rules may be called the Central Civil Services (Conduct) Second Amendment Rules, 2014.
(2) They shall come into force on the date of their publication in the Official Gazette.
2. In the Central Civil Services (Conduct) Rules, 1964, for rule 3C, the following rule shall be substituted, namely :-
‘3C. Prohibition of sexual harassment of working women, – (1) No Government servant shall indulge in any act of sexual harassment of any woman at any work place.
(2) Every Government servant who is incharge of a work place shall take appropriate steps to prevent sexual harassment to any woman at the work place.
Explanation. – (I) For the purpose of this rule,-
(a) “sexual harassment” includes any one or more of the following acts or behavior (whether directly or by implication) namely:-
i. physical contact and advances; or
ii. a demand or request for sexual favours; or
iii. making sexually coloured remarks; or
iv. showing pornography; or
v. any other unwelcome physical, verbal, non-verbal conduct of a sexual nature.
(b) the following circumstances, among other circumstances, if it occurs or is present in relation to or connected with any act or behavior of sexual harassment may amount to sexual harassment :-
i. implied or explicit promise of preferential treatment in employment; or
ii. implied or explicit threat of detrimental treatment in employment; or
iii. implied or explicit threat about her present or future employment status; or
iv. interference with her work or creating an intimidating or offensive or hostile work environment for her; or
v. humiliating treatment likely to affect her health or safety.
(c) “workplace” includes,-
i. any department, organization, undertaking, establishment, enterprise, institution, office, branch or unit which is established, owned, controlled or wholly or substantially financed by funds provided directly or indirectly by the Central Government;
ii. hospitals or nursing homes;
iii. any sports institute, stadium, sports complex or competition or games venue, whether residential or not used for training, sports or other activities relating thereto;
iv. any place visited by the employee arising out of or during the course of employment including transportation provided by the employer for undertaking such journey;
v. a dwelling place or a house.’.

Amending Rules for Safeguarding Women

Amendments to the Central Civil Services (Conduct) Rules, 1964 and Central Civil Services (Classification, Control and Appeal) Rules, 1965 have been carried out on 19.11.2014 to make working conditions more conducive for women. 



As per the new definition contained in the Explanation (1) under the amended Rule 3C of the Central Civil Services (Conduct) Rules, 1964, “sexual harassment" includes any one or more of the following acts or behaviour (whether directly or by implication) namely : -  

(i)      physical contact and advances; or

(ii)     a demand or request for sexual favours; or

(iii)    making sexually coloured remarks; or

(iv)    showing pornography; or

(v)     any other unwelcome physical, verbal, non verbal conduct of a sexual nature. 

The following circumstances, among others, if it occurs or is present in relation to or connected with any act or behaviour of sexual harassment may amount to sexual harassment : -

(i)      implied or explicit promise of preferential treatment in employment; or

(ii)     implied or explicit threat of detrimental treatment in employment; or

(iii)    implied or explicit threat about her present or future employment status; or

(iv)  interference with her work or creating an intimidating or offensive or hostile work environment for her; or

Further, as per Explanation (1)(c) under the Rule 3C of the Central Civil Services (Conduct) Rules, 1964,"workplace" includes,- 

(i)      any department, organisation, undertaking, establishment, enterprise, institution, office, branch or unit which is established, owned, controlled or wholly or substantially financed by funds provided directly or indirepictly by the Central Government;

(ii)               hospitals or nursing homes;

(iv)    any place visited by the employee arising out of or during the course of employment including transportation provided by the employer for undertaking such journey;

This was stated by Minister of State for Personnel, Public Grievances and Pensions Dr. Jitendra Singh in a written reply to Shri Rajan Vichare in the Lok Sabha  today.

OFFICE MEMORANDUM

Subject: Central Civil Service (Classification, Control and Appeal) Rules, 1965 — Instruction regarding timely review of suspension.

Rule 10 of the Central Civil Services (Classification, Control and Appeal) Rules, 1965, deals with the provisions of suspension. As per the rule, a Government servant may be placed under suspension, in the following circumstances:

(a) where a disciplinary proceeding against him is contemplated or is pending; or
(b) where, in the opinion of the authority aforesaid, he has engaged himself in activities prejudicial to the interest of the security of the State; or
(c) where a case against him in respect of any criminal offence is under investigation, inquiry or trial:

2. A Disciplinary Authority may also consider it appropriate to place a Government servant under suspension in the following circumstances. These are only intended for guidance and should not be taken as mandatory:-

(i) Cases where continuance in office of the Government servant will prejudice the investigation, trial or any inquiry (e.g. apprehended tampering with witnesses or documents);
(ii) where the continuance in office of the Government servant is likely to seriously subvert discipline in the office in which the public servant is working;
(iii) where the continuance in office of the Government servant will be against the wider public interest [other than those covered by (i) and (ii)] such as there is public scandal and it is necessary to place the Government servant under suspension to demonstrate the policy of the Government to deal strictly with officers involved in such scandals, particularly corruption;
(iv) where allegations have been made against the Government servant and preliminary inquiry has revealed that a prima facie case is made out which would justify his prosecution or is being proceeded against in departmental proceedings, and where the proceedings are likely to end in his conviction and/or dismissal, removal or compulsory retirement from service.

3. In the first three circumstances the Disciplinary Authority may exercise his discretion to place a Government servant under suspension even when the case is under investigation and before a prima facie case has been established. Suspension may be desirable in the circumstances indicated below:-

(i) any offence or conduct involving moral turpitude;
(ii) corruption, embezzlement or misappropriation of Government money, possession of disproportionate assets, misuse of official powers for personal gain;

(iii) serious negligence and dereliction of duty resulting in considerable loss to Government
(iv) desertion of duty;
(v) refusal or deliberate failure to carry out written orders of superior officers In respect of the types of misdemeanor specified in sub-clauses (iii) and
(v) discretion has to be exercised with care.

3. Rules 10(6) and 10(7) of the CCS (CCA) Rules, 1965, deal with review of the suspension cases. The provision for review within ninety day is applicable to all types of suspensions. However, in cases of continued detention, the review becomes a mere formality with no consequences as a Government servant in such a situation has to continue to be under deemed suspension. A review of suspension is not necessary in such cases.

4. It has been brought to the notice of this Department that in cases of prolonged suspension period, the courts have pointed out that the suspension cannot be continued for long and that inspite of the instructions of DoP&T, the Disciplinary Authorities are not finalizing the disciplinary proceedings within the stipulated time. Also, in such cases the Government is unnecessarily paying subsistence allowance without extracting any work and if, on the culmination of the disciplinary proceedings, the charged officer is exonerated from the charges, the Government has to unnecessarily pay the full salary and treat the period of suspension as on duty etc.. It is, therefore, desirable that timely review of suspension is conducted in a just and proper manner and that the disciplinary proceedings are finalized expeditiously.

5. All Ministries/ Departments are requested to bring the existing instructions on timely review of suspension and expeditious completion of disciplinary proceedings to the notice all concerned under their control.

  1. (1) These rules may be called the Central Civil Services (Classification, Control and Appeal) (Second Amendment) Rules, 2014.
(2) They shall come into force on the date of their publication in the Official Gazette.
  1. In the Central Civil Services (Classification, Control and Appeal) Rules, 1965 (hereinafter referred to as the said rules),-
(a) in rule 15, for sub-rules 2A, 3 and 4, the following sub-rules shall be substituted, namely:-
“(3)           (a) In every case where it is necessary to consult the Commission, the Disciplinary Authority shall forward or cause to be forwarded to the Commission for its advice:
(i)       a copy of the report of the Inquiring Authority together with its own tentative reasons for disagreement, if any, with the findings of Inquiring Authority on any article of charge; and
(ii)      comments of Disciplinary Authority on the representation of the Government servant on the Inquiry report and disagreement note, if any and all the case records of the inquiry proceedings.
(b) The Disciplinary Authority shall forward or cause to be forwarded a copy of the advice of the Commission received under clause (a) to the Government servant, who shall be required to submit, if he so desires, his written representation or submission to the Disciplinary Authority within fifteen days, on the advice of the Commission.
(4)       The Disciplinary Authority shall consider the representation under sub-rule (2) and/or clause (b) of sub-rule (3), if any, submitted by the Government servant and record its findings before proceeding further in the matter as specified in sub-rules (5) and (6).
(5)       If the Disciplinary Authority having regard to its findings on all or any of the articles of charge is of the opinion that any of the penalties specified in clauses (i) to (iv) of rule 11 should be imposed on the Government servant, it shall, notwithstanding anything contained in rule 16, make an order imposing such penalty.
(6)       If the Disciplinary Authority having regard to its findings on all or any of the articles of charge and on the basis of the evidence adduced during the inquiry is of the opinion that nay of the penalties specified in clauses (v) to (ix) of rule 11 should be imposed on the Government servant, it shall make an order imposing such penalty and it shall not be necessary to give the Government servant any opportunity of making representation on the penalty proposed to be imposed.”;
(b)       in rule 16, –
(i)        in sub-rule (i),-
  1. for the words, brackets and figure “sub-rule (3)”, the words, brackets and figure “sub-rule (5)” shall be substituted ;
  2. for clauses (d) and (e), the following clauses shall be substituted; namely:-
“(d) consulting the Commission where such consultation is necessary. The Disciplinary Authority shall forward or cause to be forwarded a copy of the advice of the Commission to the Government servant, who shall be required to submit, if he so desires, his written representation or submission on the advice of the Commission, to the Disciplinary Authority within fifteen days; and
(e) recording a finding on each imputation or misconduct or misbehavior.”
(ii)       in sub-rule (2) for clauses (vi) and (vii), the following clauses shall be substituted;
“(vi) representation, if any, of the Government servant on the advice of the                                 Commission:
(vii) the findings on each imputation of misconduct or misbehavior; and
(viii) the orders on the case together with the reasons therefor.”;
(c)        In rule 17, the words “and also a copy of the advice, if any, given by the Commission.” Shall be deleted;
(d)       In rule 19, in the second proviso, after the words “where such consultation is necessary”, the words “ and the Government servant has been given an opportunity of representing against the advice of the Commission,” shall be added;
(e)        In rule 27, in sub-rule (2), in the proviso, in clause (i) after the words “where such consultation is necessary”, the words “and the government servant has been given an opportunity of representing against the advice of the Commission.” shall be added;
(f)        In rule 29, in sub-rule (1) in the first proviso, after the words “where such consultation is necessary”, the words “and the Government servant has been given an opportunity of representing against the advice of the Commission,” shall be added;
(g)       In rule 29-A, in the proviso, after the words “where such consultation is necessary”, the words “and the Government servant has been given an opportunity of representing against the advice of the Commission.” shall be added;
(h)       rule 32 shall be omitted.

Can Central Govt Female Employees Opting for Surrogate Pregnancy Claim Maternity Leave?
Parenthood is a gift of god. Thanks to the development in medical sciences, childless couples can now opt for surrogate pregnancies. If women employees of Central Government organizations opt for surrogate pregnancies, can they claim maternity leave?
Women employees of Central Government establishments are given Maternity leave for a period of 180 days and male employees are given Paternity Leave for a period of 15 days if they choose to adopt babies. At present, there is no leave entitlements for parents of the surrogate child.
Let’s see what the Indian medical Research Council has to say about couples who choose to have babies through surrogate mothers.
Surrogacy: General Considerations
A child born through surrogacy must be adopted by the genetic (biological) parents unless they can establish through genetic (DNA) fingerprinting (of which the records will be maintained in the clinic) that the child is theirs.Guidelines for ART Clinics in India ICMR/NAMS
Surrogacy by assisted conception should normally be considered only for patients for whom it would be physically or medically impossible/undesirable to carry a baby to term.
Payments to surrogate mothers should cover all genuine expenses associated with the pregnancy. Documentary evidence of the financial arrangement for surrogacy must be available. The ART centre should not be involved in this monetary aspect.
Advertisements regarding surrogacy should not be made by the ART clinic. The responsibility of finding a surrogate mother, through advertisement or otherwise, should rest with the couple, or a semen bank.
A surrogate mother should not be over 45 years of age. Before accepting a woman as a possible surrogate for a particular couple’s child, the ART clinic must ensure (and put on record) that the woman satisfies all the testable criteria to go through a successful full-term pregnancy.
A relative, a known person, as well as a person unknown to the couple may act as a surrogate mother for the couple. In the case of a relative acting as a surrogate, the relative should belong to the same generation as the women desiring the surrogate.
A prospective surrogate mother must be tested for HIV and shown to be seronegative for this virus just before embryo transfer. She must also provide a written certificate that (a) she has not had a drug intravenously administered into her through a shared syringe, (b) she has not undergone blood transfusion; and (c) she and her husband (to the best of her/his
knowledge) has had no extramarital relationship in the last six months.
(This is to ensure that the person would not come up with symptoms of HIV infection during the period of surrogacy.) The prospective surrogate mother must also declare that she will not use drugs intravenously, and not undergo blood transfusion excepting of blood obtained through a certified blood bank.
No woman may act as a surrogate more then thrice in her lifetime

NOTIFICATION

New Delhi, the 17th January, 2014 ,

G.S.R. 27(E).—In exercise of the powers conferred by the proviso to article 309 of the Constitution, and inconsultation with the Comptroller and Auditor General in relation to persons serving in the Indian Audit and Accounts Department, the President hereby makes the following rule further to amend the Fundamental Rules, 1922, namely :—


1. (1) These rules may be called the Fundamental (First Amendment) Rules, 2014. (2) They shall came into force on the date of their publication in the Official Gazette.

2. In the Fundamental Rule, 1922, in rule 56, —

(a) in clause (k), in sub-clause (1), for item (c), the following shall be substituted namely :

“(c) it shall be open to the Appropriate Authority to withhold permission to a Government servant, who seeks to retire under this clause, if,—

(i) the Government servant is under suspension: or

(ii) a charge sheet has been issued and the disciplinary proceedings are pending; or

(iii) if judicial proceedings on charges which may amount to grave misconduct, are pending_

Explanation :–For the purpose of this clause, judicial proceedings shall be deemed to be pending, if a complaint or report of a police officer, of which the Magistrate takes cognizance, has been made or filed in a criminal proceedings.”;



(b) for clause (m), the following shall be substituted, namely :—

“(m) A Government servant in Group ‘C’ post who is not governed by any pension rules, may, by giving notice of not less than three months in writing to the Appropriate Authority, retire from service after he has completed thirty year’s service :

Provided that it shall be open to the Appropriate Authority to withhold permission to a Government servant, who seeks to retire proceedings.”;

(i) the Government servant is under suspension; or

(ii) a charge sheet has been issued and the disciplinary proceedings are pending; or

(iii) if judicial proceedings on charges which may amount to grave misconduct, are pending.

Explanation :-For the purpose of this clause, judicial proceedings shall be deemed to be pending, if a complaint or report of a police officer, of which the Magistrate takes cognizance, has been made or filed in a criminal proceedings.”;

In the Parliament a question raised by Hon'ble Member regarding the subject above quoted and the concerned minister Shri.V.Narayanasamy replied in written form to this question as follows...

REVIEW OF LTC POLICY

Government of India formulates the policies and schemes keeping in mind the various service requirements of the employees and their welfare. Various Ministries/Departments & other independent agencies of the Government of India are responsible for the proper implementation of these policies. These policies are reviewed from time to time and also amended when situation demands. 

In case of Leave Travel concession having any fraudulent activities coming to the notice of designated body/agencies, the irregularities are looked into in terms of Rule 16 of the CCS (LTC) Rules, 1988 and disciplinary proceedings are initiated against the Government servant on the charge of preferring a fraudulent claim which may result in imposition of any of the penalties specified in Rule 11 of CCS (Classification, Control and Appeal) Rules, 1965. During the pendency of disciplinary proceedings, the Government servant shall not be allowed the next two or more sets of LTC in addition to the sets already withheld.
