The undersigned is directed to refer to this Department’s OM of even number dated 4/6/2014 and 22/5/2013 where in Model Recruitment Rules (RRs) for various groups ‘B’ & Group ‘C’ posts in Non-Statutory Departmental Canteens/Tiffin Rooms located in Central Government Offices were circulated.

Subject :- Request for Voluntary Retirement from Persons suffering with disability – regarding
The undersigned is directed to say that many Government servants seek voluntary retirement on medical grounds. Sec 47 of the Persons with Disabilities (Equal Opportunities, Protection of Rights and Full Participation) Act, 19995 (PWD Act) lays down that no establishment shall dispense with the services of an employee who acquires a disability during the course of service. It is proposed that any Government servant seeking voluntary retirement on medical grounds may be apprised of the above provisions of PWD ACT, in order that he can take a considered decision.
2. A draft of the office memorandum to be issued in this regard is enclosed. Comments/suggestions are invited on the proposal. Comments may kindly be sent to the undersigned by E-mail at dsc@nic.in or by FAX at 011-23093179 by 20-02-2015.

Procedure for conduct of supplementary DPC – Dopt issued orders with illustration

Subject:- Procedure for conduct of supplementary DPC
This Department instructions issued vide OM No. 22011/5/86-Estt (D) dated 10.4.89 [para 6.4.2 (i)] provide that vacancies occurring due to death, voluntary retirement, new creations etc. could not be foreseen at the time of placing facts and material before the DPC, therefore, another meeting of DPC (commonly referred to supplementary DPC) should be held for drawing up a panel for these vacancies.
2. References have been received with regard to the zone of consideration, the eligibility list for the supplementary DPC and whether officers who are included in the panel by the original DPC or in the extended panel but could not be promoted as these anticipated vacancies do not actually become available could be appointed against the additional vacancies later becoming available for the same vacancy year.
3. These issues have been examined in consultation with UPSC and following is decided:-
(i) The zone of consideration, in case of holding supplementary DPC, shall be fixed as per the provisions in this Department OM No. 22011/2/2002-Estt(D) dated 6.1.2006 keeping in view total number of vacancies arising in a particular vacancy year i.e. vacancies accounted in Original DPC + additional vacancies becoming available subsequently during the same year.
(ii) The eligibility list for supplementary DPC shall be prepared by removing the names of all such officers who have already been assessed by earlier DPC as fit, unfit or placed in the sealed cover by the original DPC before placing the same for consideration by the supplementary DPC.
(iii) The officers who have already been empanelled or placed in the extended panel but could not be promoted due to these vacancies not actually becoming available; need not be re-assessed by the supplementary DPC as the assessment matrix remains the same. They may be appointed against the additional vacancies of the same vacancy year as per recommendations of the earlier DPC. In such situation the number of vacancies for supplementary DPC shall be accordingly adjusted.
4. While calculating the regular vacancies for a DPC, it is incumbent upon administrative department to ensure that there is no arbitrariness in calculation of anticipated vacancies.
5. To provide clarity in implementation of these instructions some situation specific illustrations are enclosed as Annexure to this OM.

For 7 vacancies, normal zone is 7 x 2 + 4 = 18
Extended Zone 7 x 5 = 35
Situation 1 - In the original DPC, first 5 officers are assessed as ‘Fit’ and no officer is assessed for extended panel or assessed as ‘Unfit’ and/or kept in ‘Sealed Cover’
Zone of consideration for Supplementary DPC will now be 13 (Normal Zone of consideration for total number of vacancies for that year — number of officers assessed by earlier DPC i.e 18-5).
As such, in the eligibility list of Supplementary DPC in the above illustration, 13 officers (9 left over officers from the original DPC and 4 additional officers) shall be included.
Situation 2 – In the original DPC, first 5 officers are assessed as ‘Fit’ and next 3 officers are assessed for extended panel and no officer is assessed as ‘Unfit’ and for kept in ‘Sealed Cover’
Zone of consideration for Supplementary DPC will now be 10 (Normal Zone of consideration for total number of vacancies for that year — number of officers assessed by earlier DPC i.e 18-8).
As such, in the eligibility list of Supplementary DPC in the above illustration, 10 officers (6 left over officers from the original DPC and 4 additional officers) shall be included.
Situation 3 - In the original DPC, 5 officers are assessed as ‘Fit’, 2 officers are assessed for extended panel and 4 officers are assessed as Unfit’ and/or kept in ‘Sealed Cover’
Zone of consideration for Supplementary DPC will now be 7 (Normal Zone of consideration for total number of vacancies for that year — number of officers assessed by earlier DPC i.e 18-11)
As such, in the eligibility of Supplementary DPC in the above illustration, 7 officers (3 left over officer not assessed in the original DPC and 4 additional officers) shall be included in the normal zone.
Extended Zone in situation 1, 2 & 3 above:
Extended zone in the Supplementary DPC, wherever resorted to, may be operated accordingly leaving out the SC/ST officers assessed by the original DPC.
Important - In the Supplementary DPC, (a) Zone of consideration (Normal as well as Extended) shall be decided taking into account total number of vacancies in the relevant vacancy year; and (b) all the officers already assessed in the original DPC are not to be included in the fresh zone of consideration in respect of the S-DPC.

In Part —A of the Proforma annexed at pages 15-18 therein, the candidate applying for compassionate appointment has to furnish a declaration/undertaking to the effect that the facts given by him/her are, to the best of his/her knowledge, correct and if any of the facts herein mentioned are found to be incorrect or false at a future date, his/her services may be terminated. The candidate has to also furnish a declaration that he shall maintain properly the other family members who were dependent on the deceased government servant/member of the Armed Forces mentioned against 1(a) of Part-A of this form and in case it is proved at any time that the said family members are being neglected or not being properly maintained by him/her, his/her appointment may be terminated. This declaration/undertaking has to be countersigned by two permanent government employees.
2. The matter has been examined in this Department. It is felt that the declaration/undertaking furnished by the applicant as at page 17 of the aforesaid Consolidated Instruction is sufficient and that there is no need of getting it countersigned by two permanent government employees. Accordingly, it has been decided to delete this provision of getting the declaration/undertaking furnished by the applicant countersigned by two permanent government employees (page 18 of the Consolidated Instructions on Compassionate Appointment). This may be brought to the notice of all concerned for information, guidance and necessary action.

OFFICE MEMORANDUM
Subject:- Central Civil Services (Leave Travel Concession) Rules, 1988 — Relaxation to travel by air to visit NER and A&N.
The undersigned is directed to say that in relaxation to CCS (LTC) Rules, 1988, it has been decided by the Government to permit Government servants to travel by air to North East Region (NER) , Jammu and Kashmir and Andaman & Nicobar Islands (A&N) as per the following scheme.
(i) All eligible Government servants may avail LTC to visit any place in NER/ A&N against the conversion of one block of their Home Town LTC. Fresh Recruits are also eligible for this benefit against conversion of one of the three Home Towns in a block of four years applicable to them.
(ii) Government servants entitled to travel by air can avail this LTC from their Headquarters in Economy class.
(iii) Government servants not entitled to travel by air may be permitted to travel by air in Economy class in the following sectors:
a. Between Kolkata/ Guwahati and any place in NER
b. Between Kolkata/ Chennai/ Bhubaneswar and Port Blair.
c. Between Delhi / Amritsar and any place in J&K
Journey for these non-entitled employees from their Headquarters up to Kolkata/ Guwahati/ Chennai/ Bhubaneswar / Delhi / Amritsar will have to be undertaken as per their entitlement.
(iv) Air travel is to be performed by Air India in Economy Class only and at LTC-80 fare or less.
(v) Air travel by non-entitled officers on the sectors mentioned in item (iii) above may be permitted while availing LTC to any place in India (4 year Block) also.
(vi) Air Tickets to be purchased directly from the airlines (Booking counters, website of airlines) or by utilizing the service of Authorized Travel Agents viz. ‘M/s Balmer Lawrie & Company’, ‘M/s Ashok Travels & Tours’ and ‘IRCTC’ (to the extent IRCTC is authorized as per DoPT’s O.M. No. 31011/6/2002-Estt.(A) dated 02.12.2009) while undertaking LTC journey. Booking of tickets through other agencies is not permitted.
2. These orders shall be in operation for a period of two years from the date of issue of this O.M.
3. All the Ministries/ Departments are advised to bring it to the notice of all their employees that any misuse of LTC will be viewed seriously and the employees will be liable for appropriate action under the rules. In order to keep a check on any kind of misuse of LTC, Ministries/ Departments are advised to randomly get some of the air tickets submitted by the officials verified from the Airlines concerned with regard to the actual cost of air travel vis-a-vis the cost indicated on the air tickets submitted by the officials.
4. In their application to the staff serving in the Indian Audit and Accounts Department, these orders issue after consultation with the Comptroller and Auditor General of India.

Sub: Grant of extension/re-employment to Central Government servants beyond the age of superannuation
Attention of all the Ministries/Departments is invited to the Government of India(Transaction of Business) Rules which prescribe that the ACC is the competent authority to decide the cases of extension in service beyond the age of superannuation.
Attention is also invited to DoPT’s OM. No. 26012/6/2002-Estt, (A) dated 09.12.2002 on the subject mentioned above laying down instructions/criteria for grant of extension in service to the categories of personnel referred in proviso to F.R. 56(d). The ACC has observed that in sorne of the cases, the Departments are not taking timely action to reconstitute the Departmental Peer Review Committee (DPRC) and are unilaterally extending the service of the officers beyond the age of superannuation without first obtaining approval of the ACC.
2. It has also been observed that Ministries/Departments often submit proposals late to the EO Division as a result of which submission of cases for consideration of the ACC also gets delayed.
3. In view of the above, all the Scientific Ministries/Departments are hereby advised to take timely action for constitution of the DPRC for considering the cases for extension
of service of specialists in medical or scientific fields, beyond the normal date of superannuation and ensure that proposals seeking approval of the ACC be invariably submitted at least two months in advance of the date of superannuation.
4. It is also reiterated that in absence of specific approval of ACC towards extension of his services beyond the date of superannuation, an officer should stand retired on his date of superannuation and under no circumstances should the Ministry/Department concerned extend his services beyond superannuation unilaterally without the approval & ACC.
