With reference to the above mentioned subject, the undersigned is directed to state that the situation arising out of issue of Office Memorandum No 2-2/2-14/CGHS(HQ)/PPTY/CGHS(P) dated the 25th August, 2014 has been engagine the attention of Government for quite some time. Although the guidelines were modified subsequentlyvide Office Memorandum of even number dated 01.10.2014 and 23.12.2014, this Ministry is in recepit of representaions seeking clarifications. The matter has been reviewed and it has now been decided to withdraw the OM of even no. dated 25.08.2014.

While answering to a unstarred question No.695 in Lok Sabha on 27th Feb 2015, Minister of Health and Family Welfare Shri.Jagat Prakash Nadda said there is no CGHS rates for implant then that implant is reimbursed as per AIIMS/GB Pant Hospital rates. However, if a benefi- ciary opts for a specific brand of implant, he/she shall have to give a written under- taking to bear the difference between the cost of that specific brand and the pres- cribed ceiling rate.

The detailed reply is reproduced and given below for your ready reference…

“The total number of CGHS beneficiaries in the country as on date are 36,67,795.

The CGHS has empanelled 750 Health Care Organizations all over the country.

As per reports received from the field, Grants Medical Foundation Pune has restricted the cashless facilities to serious/emergency cases only. Another hospitals in Ranchi ‘Shree Jagannath Hospital and Research Centre’, which was empanelled recently on 17/11/2014 has stopped this facility.

The reason for pendency of payment of hospital bills is insufficient balance of funds available with UTI-ITSL (Bill Clearing Agency) CGHS recoups funds to UTI-ITSL. There was delay in recoupment due to technical reasons. However, efforts are being made to recoup the funds to UTI-ITSL to avoid pendency.

In addition, through internal adjustment, additional funds are being allocated to Pune & Ranchi to clear the pending bills.

CGHS fixes rates for various treatment procedures and investigations through tender process and rates were last notified on 01.11.2014 for Delhi/NCR and on 17.11.2014 for CGHS cities outside Delhi/NCR. AS per the Memorandum of Agreement signed by empanelled hospital with CGHS at the time of their empanelment they are expected to charge as per CGHS package rates only.

CGHS has fixed up ceiling rates for certain implants without specifying any brand name. If there is no CGHS rates for implant then that implant is reimbursed as per AIIMS/GB Pant Hospital rates. Subject:- Revision of rates for various treatment procedures under CGHS.

With reference to the above mentioned subject the undersigned is directed to draw attention to O.M. No. S.11045/36/2012-CGHS (HEC) dated 1.10.2014 whereby CGHS package rates for various treatment procedures were notified by the Government empanelled hospitals under CGHS Delhi and NCR. This Directorate has been receiving representations from different stake holders regarding discrepancies in these notified rates.               Reimbursement to beneficiaries/empanelled hospitals shall be limited to ceiling rate or as per actual, whichever is lower.  The other terms and conditions  as regards to CGHS package rates remain unchanged. 2.  The revised rates shall come into force from the date of issue and shall be in force till further orders and are applicable in all CGHS cities. 3.  This issues with concurrence of Integrated Finance Division of Ministry of Health and Family Welfare vide diary no.C-2289 dated 13/02/2015.

Shortlisting of HCOs under continuous empanelment scheme in Delhi/NCR.

Continuous empanelment scheme had been started in all CGHS cities except Mumbai w.e.f. 10.12.2014. In Delhi/NCR applications received till 19.01.2015 has been scrutinized by screening committee regarding their technical eligibility and names of the qualified HCOs is given below.

Now all qualified HCOs are required to submit letter of acceptance of rates, MoA & Performance Bank Guarantee of requisite amount (from those HCOs which are either freshly empanelled new HCOs or earlier empanelled HCOs where PBG already submitted had expired) for consideration of their empanelment with CGHS within a period of 10 days but not later than 30 days from issuance of this order.

Removal of medicines from CGHS list – Life saving medicines – Reg.

Member of Parliament Shri.Sardar Sukhdev Singh Dhindsa asked some important questions in respect of CGHS beneficiaries regarding the life saving medicines and concerned minister has given reply on this issue as follows…

With a view to streamline the issue of medicines, an Office Memorandum was issued on 25.08.2014. Under the revised guidelines:

I. CGHS provides/ indents Medicines as per the CGHS formulary, which contains 622 branded medicines and 1447 generic medicines.

II. However, anti-Cancer and other related medicines also called Life-saving medicines, approved by Drug Controller General of India for use in India shall continue to be provided on a case to case basis.

(d) : The following measures have since been taken to overcome the inconvenience caused to the beneficiaries:

i) Since, many beneficiaries were undergoing treatment and were provided certain Insulin’s and Gliptins for anti-diabetic care, it has been decided to permit issue of such medicines to ensure continuity in treatment even though they are not included in the formulary (as an interim measure till the formulary is revised).

ii) The medicines included in the formularies of ESIC(Employees State Insurance Corporation)( 398 generic medicines) and ECHS( Ex-Servicemen Contributory Health Scheme) (517 Generic medicines) are also permitted under CGHS as an interim measure.

iii) Orders were also issued on 1.10.2014 delegating powers to CMOs i/c for providing essential medicines to CGHS beneficiaries. CMOs i/c can issue / indent medicines costing upto Rs1500 per week even though they are not included in any of the above formularies. However, in case the duration of treatment is for more than one week and the cost of medicines is more than Rs.1500/- approval of Additional Director of the concerned CGHS city must be obtained.

iv) Medicines are issued for upto three months at a time in case of chronic diseases and upto six months in case of a CGHS beneficiary going abroad. The revised Orders were issued in this regard on 21.10.2014.

Treatment under medical emergency: No referral is required and beneficiary can directly go to any private empanelled hospital for availing treatment.

II. Elective treatment at Empanelled hospitals in Delhi/NCR :

(i) CGHS/Government Specialist advises specific treatment procedure required. Permission letter has to be obtained from CGHS Wellness centre / Addl. Director of CGHS in case of pensioners, ex- MPs , etc., and from the department in case of serving employees for undergoing the treatment at any of the CGHS empanelled hospitals of his / her choice.

(ii) In satellite towns of NCR, viz., Faridabad, Ghaziabad, Gurgaon and Noida, CMO i/c of CGHS Wellness centres can refer the CGHS beneficiaries directly to private empanelled hospitals for treatment and management. In such cases permission for specific treatment procedure is to be obtained from competent authority i.e., from CGHS in case of pensioners, etc., and from the department in case of serving employees.

III. Treatment at Empanelled hospitals in other CGHS covered cities outside Delhi/NCR :

(i) CGHS beneficiaries must compulsorily be referred to Polyclinics wherever set up by the CGHS. On the advice/opinion of the Specialists/ Post graduate GDMOs, CMO In-charge, AD/ JDs may refer CGHS beneficiary to private empanelled hospitals of the choice of the beneficiary.

(ii) In those cities which do not have polyclinics and if GDMOs who are post Graduate are available, their services as specialist may be utilized and patients may be referred to the dispensary in which such PG. GDMOs are posted or if space is available in a centrally located dispensary, the PG GDMOs may be posted there.

(iii) In the event of neither a specialist nor PG GDMO is available in a city CMO In-charge shall make a provisional diagnosis and refer the patients to private empanelled hospital for specialist consultation. If any specific treatment/ procedure is advised (except in emergency) by private empanelled hospital, It must be counter-signed by CMO I/c before the services are availed to check possible misuse.

The process of referral through Government/ CGHS specialists provide a check and balance in the system, so far as correct diagnosis and treatment is concerned.

It is requested that Annual Report on the CGEGIS-1980 in respect of DAD personnel and Non-DAD personnel (Defence Civilians) may kindly be forwarded separately to this HQrs by 16th February, 2015 positively in the prescribed format (Annexure ‘D’ copy enclosed). While forwarding the report, it may please be ensured that the number of CGEGIS subscribers for the year 2014 shown in the last report must be correctly reflected in the Part-I of the report.

2. It has been noticed in previous year, the report is generally not forwarded to this HQrs by the prescribed time. This often delays rendition of consolidated report to Ministry. Therefore, it is requested that timely submission of report may please be ensured.

Various representations about the difficulties being encountered have been received from different stakeholders i.e., beneficiaries and doctors, necessitating a review of the matter. It was accordingly considered by a Committee under the Chairmanship of AS&DG,CGHS. After careful review and keeping the recommendations of the Committee in mind, the following guidelines are issued to streamline the functioning of the Wellness Centres:

i. The medicines are to be issued as per the CGHS Formulary and guidelines issued by this Ministry in this behalf.

ii. In case the prescribed medicines are not available in CGHS formulary, but are essential for the treatment of the patient, they can be issued / indented by the doctors of the CGHS Wellness Centre on the basis of a valid prescription of the authorized specialist subject to the condition that such medicines are neither dietary supplements/ food items nor banned drugs. Instructions on this issue i.e., non-admissibility of food items etc. issued vide O.M .No. 39-3/2003-04/CGHS/MSD/RS dated 23rd July 2009 and 3rd August 2009 must be followed.

iii. In case of anti-cancer drugs and other life-saving drugs that are not approved by the DCG1 for use in India, each case should be considered by the Expert Committee under the Chairmanship of Special DG(DGHS).

iv. The technical Standing Committee constituted vide 2-2/2014/CGHS(HQ)/PPTY / CGHS(P) dated 27.08.2014 of this Ministry will review addition or deletion of drugs in the CGHS Formulary/ list of Treatment procedures / investigations / listed implants. The Technical Committee will meet once in three months or as per need, whichever is earlier. In the meantime reimbursement for unlisted procedures / implants will be made at the rates approved by AIIMS/GB Pant Hospital / actuals, whichever is less.

2. The O.M. of even number dated 25.08.2014 is superseded to the above extent while O.M. of even number dated 1.10.2014 is withdrawn.
