GDS Court Case - Latest Position

GDS Court case (Writ Petition) filed by NFPE & AIPEU -GDS (NFPE) in the Supreme Court was transferred to Delhi High Court by Supreme Court.. In the meantime another case was filed by some GDS in Supreme Court through another Advocate. In that case their Advocate has agreed to file a case in Central Administrative Tribunal for getting the benefits of regular employees to GDS . Accordingly Supreme Court has given a judgement permitting them to file case in CAT. It is in this background our case in the Delhi High Court came up for hearing on 4th February 2015. The Delhi High Court has given a verdict to transfer the entire case filed by NFPE & AIPEU - GDS (NFPE) to CAT Principal Bench, New Delhi. There is no need to file separate case in CAT. Delhi High Court case will be transferred to CAT by High Court. We have decided to argue our case in CAT Principal Bench New Delhi and continue our legal battle for justice till end. In CAT it will take maximum four months for Judgement.

Subject:          Payment of Dearness Allowance to Gramin Dak Sevaks (G-DS) at revised retes w.e.f. 01.07.2014 onwards – reg.

Consequent upon grant to another installment of Dearness allowance. With effect from 1^st July, 2014 to the Central Government Employee vide Government of India, Ministry of Finance, Department of Expenditure’s O.M. No. 1/2/2014-E-II (B) dated 18.09.2014, duly endorsed vide this Department’s letter No. 8-1/2012-PAP dated 22.9.2014, the Gramin Dak Sevaks (GDS) have also become entitled to the payment of Dearness Allowances on basic TRCA at the revised rate with effect from 01.07.2014. It has, therefore, been decided that the Dearness Allowance payable to the Gramin Dak Sevaks shall be enhanced from the existing rate of 100% to 107% on the basic time related continuity Allowance, with effect from the 1^st July,2014.

2.         The additional of Dearness Allowance payable under this order shall be paid in cash to all Gramin Dak Sevaks.

3.         The Expenditure on this account shall be debited to the head “salaries” under the relevant head of account and should be met from the sanctioned grant.

4.         This issue with the concurrence of integrated finance wing vide the dairy No. 159/FA/2014-CS dated 25.09.2014.

Grameen Dak Sevaks

(a)  the State-wise number of Grameen Dak Sevaks working throughout the country at present;

(b)  whether the Ministry proposes to appoint these Grameen Dak Sevaks to the posts of postman and MTS on the basis of their seniority;

(c) if not, by when these Grameen Dak Sevaks are likely to be appointed to the posts of postman and MTS;

(d) whether the Ministry has received a demand letter from them demanding better facilities; and

(e) if so, the details of the action taken in this regard?

ANSWER

THE MINISTER OF STATE IN THE MINISTRY OF COMMUNICATIONS AND INFORMATION TECHNOLOGY (DR. (SMT.) KILLI KRUPARANI)

(a) As on 01.01.2013, the total working strength of various categories of Gramin Dak Sevaks is 263326. State-wise and UT wise details is at Annexure-I.

(b) Statutory recruitment rules of MTS already provide for their absorption to the posts of MTS on the basis of seniority. However, there is no proposal for their absorption to the posts of Postman on the basis of seniority.

(c) Absorption of Gramin Dak Sevaks to the posts of postman and MTS can only be made as per the provisions of statutory recruitment rules of postman and MTS.

(d) It is not clear from the question, which specific letter is being mention. However, some letters regarding inclusion of the category of Gramin Dak Sevaks within the purview of 7th Central pay Commission have been received.

(e) Gramin Dak Sevaks are not Central Government employees and this issue is within the domain of DoPT and Ministry of Finance.
