Subject: Implementation of Supreme Court’s judgement dated 31.10.2013 in WP(Civil) No. 82/2011 in the matter of Shri T.S. R. Subramanian & Others vs. UOI & Others — Parliament Assurance in Rajya Sabha Unstarred Q. No.988, answered on 17.07.2014, on ‘Amendment in Rule 3(3) of All India Service (Conduct) Rules’ — regarding.
The undersigned is directed to state that in reply to part (b) of the above Rajya Sabha Unstarred Q. No. 988 for 17/07/2014, the Parliament was, inter-alia, informed that ‘the directions of the Hon’ble Supreme Court in the PIL filed by Shri T.S.R. Subramanian and others were brought to the notice of the various Ministries / Departments who are the Cadre Controlling Authorities of the Central Civil Services for compliance’. This part of the reply has been treated as an Assurance.
2. It may please be recalled that, following the Supreme Court’s judgement dated 31.10.2013 in WP(Civil) No. 82/2011, the Ministries / Departments were requested to take steps for implementation of the judgement. In view of the above Parliament Assurance, all Ministries / Departments are requested to please send a line in confirmation of the implementation of the above judgement in respect of the Cadre(s) under their administrative control by 20.03.2015 so that the Assurance can be fulfilled. The Cadre(s) under the administrative control may also please be indicated for records.
3. The Ministries / Departments, which are not Cadre Controlling Authorities for any cadre, may also kindly send a communication in this regard for the records of this Department.

(a)Railways have provided Wi-Fi facility in Howrah-New Delhi, Howrah Rajdhani Express (3 rakes) as a pilot project in April 2013 using satellite communication technology for continuous connectivity. A work of provision of Wi-Fi facility in 50 rakes of Rajdhani, Shatabdi and Duranto category trains has been included in Works Programme 2013-14. Initially, as phase I, one Rajdhani Express train and Shatabdi Express (Total 5 rakes) are planned.
(b)By the end of current Financial Year, agency to execute the work in 5 rakes will be finalised.
(c)Currently there is no plan to provide Wi-Fi facility in all trains in Superfast category.
(d)The estimate approximate cost on providing Wi-Fi facility in 50 rakes of Rajdhani/Shatabdi and Duranto Category train is 98.6 crores.

(a) whether Government has cautioned officials against misusing the Leave Travel Concession (LTC) claims option;Will the Minister of PERSONNEL,PUBLIC GRIEVANCES AND PENSIONS be pleased to state :-
(b) whether Government has decided to carry out random verification of air tickets submitted by officials to ascertain whether the LTC claim is genuine; and
(c) whether a Government officials found indulging in any malpractices in this regard, can be penalized and prevented from availing LTC for the next two to three years, if so, the details thereof?

(a) & (b): Yes, Sir. All the Ministries/Departments have been advised to bring it to the notice of all their employees that any misuse of LTC will be viewed seriously and the employees will be liable for appropriate action under the rules. Further, to keep a check on any kind of misuse of LTC, Ministries/Departments have been advised to randomly get some of the air tickets submitted by the officials verified from the Airlines concerned with regard to the actual cost of air travel vis-a-vis the cost indicated on the air tickets submitted by the officials.
(c): In case of any fraudulent activities in Leave Travel Concession coming to the notice of the designated body/agencies, the irregularities are looked into in terms of Rule 16 of the CCS (LTC) Rules, 1988 and disciplinary proceedings are initiated against the Government servant on the charge of preferring a fraudulent claim of LTC. If the disciplinary proceedings result in imposition of any of the penalties specified in Rule 11 of CCS (Classification, Control and Appeal) Rules, 1965, the Government servant shall not be allowed the next two or more sets of LTC in addition to the sets already withheld.

Medicines, which are not included in these formularies and not available in dispensaries, when prescribed by Government Doctors are being procured through Local Purchase at the discretion of CMO I/C (Chief Medical Officer In-charge) of the Wellness Centres

(a) & (b): The Government has notified a minimum pension of Rs.1,000/- per month under Employees’ Pension Scheme, 1995 vide G.S.R. No.593(E) dated 19.08.2014 for the year 2014-15 with effect from 01.09.2014. It has benefited all members, widow/widower, disabled, nominee and parent pensioners drawing pension less than Rs.1000/- under the Scheme. The policy has also benefited children and orphan pensioners whose minimum pension would be Rs. 250/- per month and Rs.750/- per month respectively. 32 lakhs pensioners (Approximately) under Employees’ Pension Scheme, 1995 have been benefited under the policy.
(c): Pensioners under Employees’ Pension Scheme, 1995 getting less than Rs. 1000/- per month are getting top-up amount over and above the pension they are getting to make it to Rs. 1,000/- per month. Besides, children and orphan pensioners are getting a minimum pension of Rs. 250/- and Rs. 750/- per month respectively. The total financial benefit to the pension holders in implementing the minimum pension under Employees’ Pension Scheme, 1995 is estimated to be Rs. 709 crores for the period 01.09.2014 to 31.03.2015.

(a) & (b) The eMigrate Project launched by the Ministry of Overseas Indian Affairs (MOIA) on 26th May, 2014 has been designed to facilitate and improve emigration management of workers from India. It is a comprehensive system covering entire spectrum of emigration including foreign employers, Indian Missions and Posts abroad, Protector of Emigrants Offices, MOIA, Recruiting Agents, Emigrants, Insurance Agencies, Ministry of External Affairs and Bureau of Immigration. It is aimed at ensuring safe and legal emigration of Emigration Check Required (ECR) passport holders to ECR countries. The objective of the system is to ensure that all stake holders like foreign employers, recruiting agents, emigrants, Indian Missions & Posts and MOIA officials are accessing a unified platform. It has inbuilt provision for accessing Passport Seva database for validation of passports. However, it has no effect on issuance of passports.
(c) The following steps have been taken by the Ministry of External Affairs to further simplify the mechanism of issuing passports:-
i. Police Verification: Police Verification of applicants’ particulars plays an important role in timely dispatch of passports. The Ministry as well as the Passport Offices continue to engage closely with the Police Departments across States/Union Territories and with concerned Home Departments to reduce time taken in police verification.
ii. Passport Portal: A more user-friendly portal http://passportindia.gov.in was released in September 2013. The Passport Portal is kept updated with Advisories/Notices and Press Releases relating to Passport services developments.
iii. To address the concerns relating to availability of appointments, the Ministry introduced Online Payment System in July 2013. There has been a noticeable improvement in availability of appointments since then. There are certain categories of applicants and services for which ‘walk-in’ facility is available.
iv. mPassport Seva mobile app, which was launched on Android platform in March 2013, has been made available on Windows and Apple iOS platforms. This app provides passport related information including PSK locator, applicable fees, mode of submission and tracking of passport application status on smart phones.
v. The Passport Seva system sends four free of cost SMS to applicants - (i) at the time of dispatch of passport, (ii) in ‘returned undelivered’ passport cases, (iii) rejection of request for counter delivery cases and (iv) clear Police Verification(PV) report in pre-PV PCC cases or review of PV and clearance by the PIA. In addition, a premium optional SMS Service, on nominal payment basis, has been made available to enable citizens to receive alerts and updates regarding detailed progress of their passport applications and pending actions. The service can be availed from any mobile phone.
vi. Common Services Centres (CSCs): With a view to address the challenge of digital divide, especially in the rural hinterland, the Ministry in association with CSC e-Governance Services India Ltd. (which is promoted by the Department of Electronics and IT), has facilitated online filing of passport applications, through the vast network of over one lakh CSCs across rural hinterland. The arrangement was firmed up in March 2014.
vii. Passport Melas: In order to speed up passport issuance and meet high or seasonal demand for Passports, Passport Melas are organised from time to time on weekends at PSKs by Passport Offices.
viii. Passport Adalats, on need basis, are also conducted by Passport Offices to redress passport service grievances by dealing with citizens directly.
ix. Greater outreach: The Ministry is working on setting up 18 more Passport Seva Kendras(PSKs) in addition to the existing functional 77 PSKs across the country.
x. Passport Seva Camps: In order to provide closer and speedier passport services to people located far away from PSKs, the Ministry is organizing Passport Seva Camps at various locations in the country.
xi. Simplification of procedure: It has been decided to accept registered rent agreement as proof of address. It has also been decided w.e.f. 1st August, 2014 to do away with ink signatures on passports and replace these with stamped signatures to save time and manpower. The Ministry has also introduced the system of self-attestation of documents replacing the requirement of attestation by gazetted officers.

Performance of Post Offices is monitored on selected Key Performance Indicators (KPIs) on Mails, Savings Bank and Money Orders through a web based mechanism.
The Government has undertaken the following steps to improve efficiency of Postal Services by:
(i) Introduction of a Mail Network Optimization Project (MNOP), for consolidation and optimization of operational network.
(ii) Process redesigning at Speed Post Hubs and Intra Circle Hubs.
(iii) Strengthening of end –to-end online tracking system, resulting in increase in online tracking.
(iv) Regular performance review of all Postal Circles.

There are sufficient numbers of sanctioned posts of Gramin Dak Sevak (GDS) employees in rural areas. In addition, the Department has recently directed for expeditious filling up of all vacant posts of Gramin Dak Sevak Branch Postmasters

(a): Inclusion of 110 entries (by way of castes, their synonyms, sub castes etc.) in the Central List of Other Backward Classes (OBCs) has been done during the year 2014 for 20 States/Union Territories. Further, the inclusion of castes/communities in the Central List of OBCs is a continuous process. This Ministry notifies castes/communities in the Central List of OBCs for different States/Union Territories on consideration of the advice tendered from time to time by the National Commission for Backward Classes under Section 9(1) of the NCBC Act, 1993. Till date 2404 such entries (by way of castes, their synonyms, sub castes etc.) have been notified (Annexure-I) in the Central List of OBCs through 32 notifications.
(b): The State-wise details of 110 entries (castes, their synonyms, sub castes etc.) included in the Central List of OBCs in 2014 are attached as Annexure-II. Apart from these, the Ministry has received 7 advices from the NCBC and one advice from the Jammu and Kashmir State Backward Classes Commission (as per details at Annexure- III), which are under examination .
